The Incorporated Trustees of the Southern Kaduna Peoples’ United Association (SOKAPU) has filed a lawsuit at the Federal High Court in Kaduna against the Minister of Works, David Umahi, over the death of Mary Habila, a nurse who was attached to the minister’s medical team.



Mary Habila reportedly died on June 27 at the minister’s residence, an incident that has continued to generate public concern and renewed calls for a full investigation into the circumstances surrounding her death.



Also named as respondents in the suit are Habila Tanko Wisdom, the deceased’s father, the Attorney-General of Ebonyi State and the Commissioner of Police in Ebonyi State.

In the case before the court, SOKAPU is asking for an order directing that an autopsy be conducted on the late nurse to determine the exact cause of her death.



The association is also seeking N20 billion in damages against the minister, alleging that the deceased lost her life as a result of a breach of duty of care while she was under his custody.


The legal action comes after earlier developments in which the Ebonyi State Police Command insisted that an autopsy would be carried out despite reports that some members of the deceased’s family were opposed to the procedure.

Umahi had earlier written to the Ebonyi State Commissioner of Police, requesting that an autopsy be conducted to establish the circumstances surrounding Habila’s death.

The suit is expected to examine legal issues relating to duty of care, accountability and the process of determining the cause of death through judicial and investigative procedures.


As of the time this report was filed, the Federal High Court had not fixed a date for the hearing of the case.
